A district judge decided Tuesday there is enough evidence for Lamont Cherry to stand trial.

The man from Wilkes-Barre has been charged with the beating death of his girlfriend's baby. He is facing a trial on a homicide charge.

Police said in May Cherry was watching his girlfriend's one-year-old daughter, Zalaiya McCloe at a home on Carlisle Street.

When the child's mother returned home, she told investigators, the baby was changing colors and not breathing.

In court a forensic expert testified little Zalayia was killed, spanked and beaten, her skull fractured in several places. There was bruising on her neck and the back of her head.

A police detective testified when asked about what happened, Cherry said he didn't know.

Lamont Cherry is locked up at the Luzerne County jail awaiting a formal arraignment in county court.

Zalaiya McCloe's family had no comment on Tuesday's ruling.
